Results of the EGM

So far there is no official result published. As soon this will be happen we can start to discuss the minutes. But I want to thank all the owners have been present for their attendance. I guess, there were more present than at the AGM. Like that! Personaly I am quite happy with the results. There is definitivly more to talk about and to discuss, but we are on a good direction. Let´s go together that road and I am sure that we gain more life quality at our home, La Finca.

"Except by virtue of what was agreed on today, and only at the point of playground related above, the votes cast by the debtor only by playground derrama owners count as valid.

AGENDA
1.- The proposed Children's Play area at La Finca.
The meeting starts with the assistance of Ms. Isabel Lindemann, lawyer of the community.
Mrs. Pilar Rodriguez says that the lawyer cannot invoice community for different matters than legal actions against debtors (monitorios). Mrs. Elizabeth Lindemann answers that attends the meeting at the request of the President and is here to represent the community as a whole and to inform all the neighbours of any legal aspect or doubt arising on this meeting.
Mrs. Pilar Rodriguez says she believes that owners who only owe the extra payment (derrama) should be able to vote, because the debts were not liquidated according with the LPH. Elizabeth Lindemann answers that liquidation and approval of debtor’s balances are only necessary for submission of court actions (monitorios) against debtors,
Mrs. Maureen Eaves says that there is an error in the list of debtors, because apartment C-101 was not in the agenda list and in the current list appears. The Administrator answers do not have the details here, shall be reviewed at the office.
Mrs. Pilar Rodriguez is of the view that the agreement ofthe previous EGM could be challenged, since according to article 18.3 of the LPH needs unanimity to modify the statutes (where establish the prohibition of making works that alter the structure of the building ). Mrs. Elizabeth Lindeniann replied that in this type of modifications (if they are or not) have to be decided by ajudge. Mrs. Pilar Rodriguez said that some representations erasures and amendments at dates and signatures, so the previous EGM could also be challenged. Mrs. Elizabeth Lindemann says that the minutes were sent to owners, so far it has not contested, the agreement is executive, those who wish may be challenged, and that the representations can be ratified by the owners. The President asked Mrs Pilar Rodriguez, whether as a lawyer representing some owner and she responds only
represents to Mr Javier Sarmiento, owner of the apartment B-214. There is a debate among participants about the project of the playground. Finally, the following proposals were made:
— Stop the execution of the works of children play area agreed at the meeting of 26/04/ 1 0 (among other reasons because all the money is not available to do the work).
— To agree a solution with simple majority for the modification of article 10 of the house rules.
— Mr. Juan Lorenzo Suarez Moreno proposes to use as a playground for children common areas where Community meetings are now held (next to the toilets), and put there a table tennis, ping pong child, child golf, table and chairs and small house for girls games (provides budgets from Ikea, Decathlon, and Toys R us, total amount of 1.032.75€). With this proposal there no need to make any extraordinary expenditure or work. and children would have a games area. Put to the vote the proposals with the following results:
— Were agreed unanimously to have a games area for children in the building.
— Per unanimously agreement were decided the cancellation of the extra charge ( derrama) for children play ground area agreed at the last meeting on 04/26/ 10, and rehabilitating those owners (and their votes) who only owed this playground extra payment. Were agreed by unanimity that owners who have paid this extra payment will have a deduction from the payment of Corrununity fees from November/10, until the cancellation of the balance in his favour (details of balance in favour will be send to owners).
— It is agreed unanimously to modify the article 10 of the house rules of the building, authorizing only as a playground for children common area where Community meetings are now held (next to the toilets).
— Per unanimously agreement were decided the following time table for this children play ground area:
from Monday to Friday: from 09:00 h. until 14:00 h.; and from 16:00 h. until 21:00 h.
Saturdays and Sundays: from 11:00 h. until 14:00 h., and from 16:00 h. until 21:00 h.
— Starts a debate about if ball games should be allowed or not in that area, because those games are the ones that create more damage in common areas (walls, gardens, etc.), and noise.

By majority agreement were decided to do not allow ball games.

2.- Any other Business.
- We have been in touch with the contractor which made paint pool jobs to come to remedy problems of
detachment of painting which have begun to appear.
